What do you expect them to say? They're counter jockeys for a smaller company getting skunked by the huge retailers. They charge more, inconvenience customers with preorders that they don't need, rip off customers on trade-ins, and generally demonstrate no reason to exist other than the fact that they generally get releases before the big box stores. So when the big box stores get it first, they're ticked.
Nintendo will not charge Target, WalMart, Sears, or anyone else a $1,000 per unit penalty, even though they may very well have some sort of vague retailer agreement that states that. As has already been pointed out in this thread, Nintendo depends way too much on the WalMarts, Targets, Sears, and even EB/GS of this world to jeopardize relations with ridiculous fines like this.
